The district court ordered the restaurant owner to pay a total of €93,160 in unpaid wages and €42,480 in compensation for unlawful termination of employment to the five employees. According to the ruling, the company also violated the prohibition of discrimination under the Non-Discrimination Act by treating workers less favourably based on their origin, nationality or language. The company was ordered to pay each employee €2,000 in compensation for discrimination, amounting to €10,000 in total. In addition, the company will incur legal costs of over €100,000. The decision is not yet legally binding. The restaurant owner has expressed dissatisfaction with the ruling. According to the Non-Discrimination Act, no one may be discriminated against on the grounds of origin, nationality or language. Direct discrimination means someone is treated less favourably than another person is treated, has been treated or would be treated in a comparable situation because of a personal characteristic. A person who has been subject to discrimination is entitled to compensation from the employer who violated the Non-Discrimination Act.
